Rental Tenant Assistance Bylaw

Tenant protection bylaws can require owners of residential properties to support tenants displaced due to the redevelopment of purpose-built rental buildings. On 2026-JUL-27, Council adopted the "Residential Tenant Assistance Bylaw 2026 No. 7459" and related amendments to the "Bylaw Notice Enforcement Bylaw 2012 No. 7159". 

This bylaw applies all lands within the City of Nanaimo for Zoning Bylaw amendments (rezonings), Development Permits, Demolition Permits, and Building Permits that involve the redevelopment (demolition or partial demolition) of a building containing four (4) or more rental units that will result in the displacement of tenants. The bylaw requires the following:

  • Development application submission requirements (for property owners);
  • Communications (from property owners to tenants);
  • Financial compensation including 4 months rent, based on the greater of the current rental rate, or the Canada Mortgage and Housing Corporation’s (CMHC) average rent for a comparable unit, and moving costs (from property owners to tenants); and 
  • Compliance reports requirements (for property owners).

      What properties does the Residential Tenant Assistance Bylaw apply to?

      The bylaw applies city-wide to the redevelopment (demolition or partial demolition) of a building containing four (4) or more rental units that will result in the displacement of tenants.

      What tenants are eligible?

      The bylaw defines "tenant" as a person or persons residing in a rental unit on whose tenancy agreement is terminated in relation to a proposed redevelopment. The bylaw requires rental building owners to provide communications to tenants during development applications, and financial compensation in the amount of 4 months rent (not including the 1 months rent required under the Residential Tenancy Act), and moving costs once a notice to end tenancy has been issued.
