Colliery Dams Update

Summary

The City of Nanaimo has received a copy of a written submission from the Comptroller of Water Rights’ lawyer regarding the City’s application for a stay of the Comptroller Order to remediate the Colliery Dams. This submission will be forwarded to the Environmental Appeal Board (EAB) requesting that the City’s application for a stay be denied.

Key Points

  • Previously, the City lawyer had made application for an appeal and stay of the Comptroller’s Order as directed by Council. The City lawyer will make a further written submission in response to the Comptroller’s lawyer’s submission, which will be completed by June 24.
  • Once the City lawyer’s application is received, the EAB will schedule a review of the written submissions of both parties and provide a decision on the City’s application for a stay. The EAB’s decision is expected in early July.
