Statement on Discontinuance

By a unanimous vote, Council has decided to file a Notice of Discontinuance in respect of the matter The City of Nanaimo vs. William McKay.

On Monday, December 18, 2017 Council deliberated on options available to proceed with several matters of alleged violations by Mayor McKay of the Community Charter confidentiality provisions, oath of office and provincial privacy laws.

The justice system requires complaints filed be acted on within a 12-month window. Given the time constraints and delays in the judicial system as well as the delays to address the issues by the Respondent and his legal team, Council has chosen the alternative route of a censure hearing to achieve a meaningful outcome.

A censure hearing will be convened in early 2018.
