Committee Recommendations

Council approved accelerating the Community Safety Officer’s vehicle project from 2023 to 2022 in the 2022 – 2026 Financial Plan.

Council awarded an “Other Grant” in the amount of up to $10,000 for the 2022 calendar year to Growing Opportunities (Farm Community Cooperative), with funding to come from the Strategic Infrastructure Reserve Fund. The funding will be used to cover the organization’s water usage costs for summer 2022 irrigation.

Council directed staff to submit an application under the B.C. Active Transportation Infrastructure Grant for the Albert and Fourth Complete Street Phase 2 project.

Section 10a

Delegations

Ann Livingston spoke regarding the operation and services of the Nanaimo Area Network of Drug Users (NANDU) overdose prevention site.

Ruth Taylor spoke regarding the impacts of the NANDU site on the neighbourhood and safety concerns for NANDU clients and nearby residents and business owners.

Brunie Brunie spoke asking Council to not move unhoused people from place to place but to designate an area for them to congregate.

Presentations

Charlotte Davis (Manager, Park Operations) and David Thompson (Manager, Roads and Traffic Services) gave a presentation regarding snow and ice preparedness and an overview of the City’s response plan.

Section 8a

Development around Nanaimo

Council confirmed a resolution regarding 5 Durham Street that was passed at the October 3, 2022 Regular Council meeting. If the owner continues to take action to ensure a building permit is secured, as noted in their delegation to Council, no remedial action will be required.

Section 12a

Council issued four Development Variance Permits to allow for LED menu board signs at the McDonalds restaurants located at 1213 Princess Royal Ave, 6675 Mary Ellen Dr, 1835 Bowen Rd and 4275 Rutherford Rd.

Section 12b

Council issued a Development Variance Permit for 6566 Kestrel Crescent, to allow for an addition to an existing single residential dwelling.

Section 12c

Council issued a Development Variance Permit for 2592 Departure Bay Road, to reduce the minimum side yard setback to allow for a proposed single residential dwelling.

Section 12d

A Rezoning Application for 5645 and 5655/5657 Metral Drive, to facilitate a multi-family development, passed two readings. 

Section 12e

Council directed Staff to proceed with public notice regarding an application to change the covenants on the property titles of 514, 540 Haliburton Street, 120 Needham Street and 575 Nicol Street prior to an upcoming Council meeting.

Bylaw Updates

“Zoning Amendment Bylaw 2021 No. 4500.196” (to rezone 6033 and 6053 Nelson Road from the Single Dwelling Residential [R1], Duplex Residential [R4], Low Density Residential [R6] and Parks Recreation and Culture One [PRC-1] to Low Density Residential [R6] and Medium Density Residential [R8] and Parks Recreation and Culture One [PRC-1] to allow a multi-family residential development) was adopted.

“Sewer Regulation and Charge Amendment Bylaw 2022 No. 2496.36" (a bylaw to include a provision that points to the Appeals Procedure Bylaw and other housekeeping amendments) was adopted.

Section 13b

“Flood Prevention Amendment Bylaw 2022 No. 5105.01" (a bylaw to include a provision that points to the Appeals Procedure Bylaw and other housekeeping amendments) was adopted.

Section 13c

“Waterworks Rate and Regulation Amendment Bylaw 2022 No. 7004.19” (a bylaw to include a provision that points to the Appeals Procedure Bylaw and other housekeeping amendments) was adopted.

Section 13d

“Management and Protection of Trees Amendment Bylaw 2022 No. 7126.02” (a bylaw to include a provision that points to the Appeals Procedure Bylaw and other housekeeping amendments) was adopted.

Section 13e

“Property Maintenance and Standards Amendment Bylaw 2022 No. 7242.02” (a bylaw to include a provision that points to the Appeals Procedure Bylaw and other housekeeping amendments) was adopted.

Section 13f

“Business Licence Amendment Bylaw 2022 No. 7318.01” (a bylaw to include a provision that points to the Appeals Procedure Bylaw) was adopted.

Section 13g

“Chauffeurs Regulation Amendment Bylaw 2022 No. 7319" (a bylaw to include a provision that points to the Appeals Procedure Bylaw) was adopted.

Section 13h

"Bylaw Notice Enforcement Amendment Bylaw 2022 No. 7159.17" (a bylaw to correct references to bylaw provisions and address fine inconsistencies) was adopted.
